At Canada Rx Connection protecting your personal information is a primary concern. We are committed to meet or exceed the privacy standards established by Canada's Personal Information Protection and Electronic Documents act.
Limitation Policy
The personal information collected must be limited to that necessary for the purposes identified by Canada Rx Connection. Personal information may only be used or disclosed for the purpose for which it was collected. We use your personal information to communicate with you, enhance your visit to our site and process orders effectively.
We will not furnish personal information to any outside organization for use in marketing or solicitation.
Security Policy
We refer for dispensing purposes to our contracted licenced Canadian pharmacies and international government approved dispensing facilities information we receive from you. However when you visit our website, information is not collected that could identify you personally unless you choose to provide it voluntarily. You are welcome to browse the website at any time anonymously and privately without revealing any personal information about yourself.
Computer Software & Hardware Security Policy
We use current technologies and maintain security standards to ensure that your personal information is protected against unauthorized use or misuse. All safety and security measures are appropriate to the sensitivity level of your information. Any electronic files are kept in a secured environment with restricted access. Any paper-based files are also stored in restricted access areas. We manage our server environment appropriately and our firewall infrastructure is strictly adhered to. Our security practices are reviewed professionally from time to time and we employ the most current technology available to assist us in protecting the confidentiality and privacy of your information.
Amending Information Policy
To help us keep your personal information up-to-date we encourage you to amend any inaccuracies that may occur and make corrections as quickly as possible. Despite our efforts, errors sometimes do occur. Should you identify any incorrect or out-of-date information on your prescriptions, we will make the proper changes and provide you with a copy of the corrected information.
Updating Policy
We may add, modify or remove policies or portions of our policies when we feel it appropriate or necessary.
Terms Of Sale Policy
The following terms and conditions (A thru P) govern the referral of products for sale by Canada Rx Connection's affiliated licenced Canadian based pharmacies and its government approved dispensing facilities to you. By accepting delivery of the product(s) ordered, you the customer agree to be bound by and accept these terms (A thru P):
A) Other Documents. These terms may not be altered, supplemented, or amended by the use of any other document. Any attempt by customer to alter, supplement or amend this document or to enter into an order for product(s) that is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both customer and Canada Rx Connection.
B) Governing Law. These Terms will be governed by and construed in accordance with the laws of the province of Manitoba and the laws of Canada applicable therein, without giving effect to any principles of conflicts of laws. All disputes, controversies or claims arising out of or in connection with these Terms shall be submitted to and be subject to the jurisdiction of the courts of the Province of Manitoba, Canada. The parties submit and attorn to the exclusive jurisdiction of the courts of the Province of Manitoba, Canada to finally adjudicate or determine any suit, action or proceeding arising out of or in connection with these Terms.
C) Policies. By submitting an order for products and services to Canada Rx Connection, the customer consents to the collection and use of personal information as described above. Canada Rx Connection reserves the right to amend its policies from time to time by posting the updates on its web site. The customer agrees to review the policies each time it submits an order for products or services.
D) Orders; Prices; Payment. Orders are not binding upon Canada Rx Connection until accepted by Canada Rx Connection. The prices for the products shall be quoted by Canada Rx Connection at the time of acceptance of an order by Canada Rx Connection. Prices for products shall be subject to change without any further notice. Payment must be received by Canada Rx Connection prior to Canada Rx Connection's acceptance of an order. Payment for the products will be made by a credit card accepted by Canada Rx Connection, wire transfer, bank draft, or money order.
E) Shipping Charges. Separate charges for shipping will be shown on Canada Rx Connection's affiliate dispensing pharmacy's invoice.
F) Title. Title to products passes from one of our affiliated pharmacies or government approved dispensing facilities to customer at the time the products leave the shipping point for delivery to the Customer. Ship dates are estimates only. Canada Rx Connection is not liable for delays in shipment or failure to ship by the estimated ship date.
G) Warranties. THE MANUFACTURER OF EACH PRODUCT IS SOLELY RESPONSIBLE FOR ANY WARRANTY ASSOCIATED WITH THE PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Canada Rx Connection DISCLAIMS ANY WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, IN RESPECT OF THE PRODUCTS AND SERVICES CONTEMPLATED BY THESES TERMS AND CONDITIONS INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Canada Rx Connection's RESPONSIBILITY FOR CLAIMS IN RESPECT OF THE PRODUCTS IS LIMITED TO REPLACEMENT OF THE PRODUCT.
H) Return Policy. Due to the nature of the products, products are not returnable. All sales are final sales.
I) Exchanges. From time to time, Canada Rx Connection may, in its sole discretion, exchange and replace a product, in the event of damage or defect of the product. Any exchanges will be made in accordance with Canada Rx Connection's exchange policies in effect on the date of the exchange.
J) Products. Canada Rx Connection may revise and discontinue products at any time without prior notice.
K) Limitation of Liability. Canada Rx Connection does not accept liability beyond the remedies set forth herein including, without limitation, any liability for products not being available for use or delays experienced in customers receiving products that have been purchased. To the maximum extent permitted by law, Canada Rx Connection will not be liable for damages arising from personal injury or death, lost profits, loss of business or other loss or damage relating in any way to products or services whether direct or consequential, special, indirect or punitive, even if advised of the possibility of such losses or damages, or for any claim by any third party. The foregoing limitations apply regardless of the causes or circumstances giving rise to such loss, damage or liability, even if such loss, damage or liability is based on negligence or other torts or breach of contract including, without limitation, fundamental breach or breach of a fundamental term.
L) Exports. The customer acknowledges that the products sold hereunder are subject to applicable export control laws and regulations.
M) Entire Agreement. Customer agrees that these terms and any document incorporated by reference or referred to herein constitute the entire agreement between customer and Canada Rx Connection pertaining to the subject-matter of these terms and conditions, and supersedes, terminates and otherwise renders null and void any and all prior agreements, understandings, negotiations, contracts, proposals or requests for proposals whether written or oral, between customer and Canada Rx Connection. In the event of a conflict between these terms and conditions of sale and any of the documents incorporated by reference or referred to herein, these terms and conditions of sale shall govern.
N) Severability. The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision hereof and any such invalid or unenforceable provision shall be deemed to be severable.
O) Headings. The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom.
P) Force Majeure. Canada Rx Connection shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including, without limitation, delays due to backorders of requested products, mail delays, or lost shipments. Canada Rx Connection shall not be responsible to notify the customer in the event of such delays. Customer shall be solely responsible to make other arrangements to purchase alternative products and for any costs incurred in connection with such purchases.
